Centre Regulations
It is necessary to have some basic regulations governing the use of the Centre. Mature and responsible conduct will enable the application of the regulations to be kept to a minimum. |
Interpretation The Chief Secretary shall determine any questions arising as to the interpretation of these regulations. In these regulations:- 1 -The 'Centre' means (where context permits) the building know as Beau Sejour Leisure Centre and all the surrounding land, Beau Sejour Park including in particular all pathways, access roads, car parks, playing fields and other recreational areas and any buildings, structures or appliance thereof under the jurisdiction of the States. 2- The 'Chief Secretary' refers to the person so appointed to the post of Chief Secretary to the Committee for Education Sport & Culture, or in his/her absence a duly authorised representative. 3- The 'Management' includes (where the context permits) any officer of the Centre authorised by the Chief Secretary to perform any particular duty. 4- The 'User' means any person using the Centre or any of its facilities whether or not any charge has been made and includes a spectator. 5- The 'States of Guernsey' means the body of people elected to govern the Island of Guernsey. |
Charges Charges for memberships, admission and the use of the facilities shall be determined from time to time by the States of Guernsey acting by and through Sport and Recreation Services as part of the Committee for Education Sport & Culture (hereinafter referred to as The States). The States reserve the right to vary charges without notice but shall endeavor to provide notice of any changes through the local media and within the Centre itself. |
Admission The management reserves the right to refuse admission or require any person to leave the Centre if it has reason to believe that they could behave or dress in a manner that is likely to be offensive, create a nuisance or annoyance in any way or which could present a risk to a person's safety or damage to property. |
Liquor Beau Sejour Leisure Centre as Licensed premises is subject to the Liquor Licensing Ordinance of 2006 and any subsequent amendments. The Centre reserves the right to refuse entry to any events where intoxicating liquor is being served to any person believed to be under the influence of alcohol or drugs. A strict over 18 policy is in operation and persons who cannot produce appropriate identification (passport or full driving license) will not be served. Any underage person found to be under the influence or in possession of any alcoholic beverage or any person found to be supplying intoxicating liquor to an under 18 year old will be asked to leave the premises immediately. An Under 18's permit applies to the Bar and Café on level 2. Unaccompanied under 18's may be present in this area until 8pm. After this time they will be asked to leave if they are not accompanied by a person over the age of 18. |
Membership Admission to the Centre and the use of the facilities by members is also subject to the terms and conditions of the membership scheme. |
Booking of facilities and Charges. Subject to availability, the sports and health suite facilities may be booked for casual use no more than eight days in advance by Freedom Plus members, seven days in advance for all other members and six days in advance for non-members. Coaching courses may also be booked when available. All charges must be paid before the start of the booked period or in the case of a course before the first coaching period. The Management may require payment in full at the time of the booking. In the event of a booking being cancelled within less than 24 hours' notice, or not taken up, the charge shall remain due, but if the booking is resold then the management may, at its discretion, waive the charge. In the case of outdoor facilities a charge will not be made when adverse weather or surface conditions prevent play from taking place. In the event of a member cancelling a booking within less than 24 hours' notice, or not taking the booking up, the casual charge for the class or activity shall be levied on the member. If the booking is resold then the management may at its discretion waive the charge. The States reserve the right to refuse an application or to cancel or terminate a booking at any time. In the event of this right being exercised, the States shall not incur any liability for breach of contract or otherwise or be held liable for any expenses incurred by third parties either directly or indirectly as a result of such a refusal, cancellation or termination. However, the States shall at their discretion either attempt to rebook at a new time and date that is convenient to the customer or provide a full refund or any monies already paid. |
Young Children and Vulnerable Adults Children under the age of 8 years can only enter Beau Sejour Leisure Centre if they are accompanied by their parent or an adult (16 years and older) and are actively observed at all times. If a child under 8 years is attending a class or activity within the Leisure Centre the accompanying parent or other person over 16 must wait until the child has been registered with the class teacher before leaving and then must remain on the viewing gallery or in the cafeteria during their child's lesson. Depending on care needs, Vulnerable Adults should be accompanied by their parent or carer whilst visiting Beau Sejour Leisure Centre. |
Safety Regulations In all activities involving some risk of injury (such as five-a-side, trampolining, etc.), all users must be supervised by a responsible person approved by the management. However, such supervision does not detract from a user's responsibility to advise the supervisor of any information material to his/her participation in an activity. Any accident, however seemingly trivial, must be reported to the Duty Manager and full particulars of the injured person(s) given so these details may be recorded. |
Injury The use of the Centre and of all equipment, facilities and amenities and the participation in all activities is permitted entirely at the user's own risk. The States will not accept liability for any personal injury to any user or participant or the consequential loss otherwise than as a result the negligence of the States, their agents, officers or servants. |
Dress Dress should be smart and appropriate to the activity for which the Centre is being used. The use of mud stained outdoor sportswear within indoor sports areas is prohibited. All footwear must be a non-marking type. |
Smoking In line with local legislation smoking is prohibited throughout the Centre. The use of vaporised cigarettes within the Centre is also prohibited. |
Property All users placing or leaving articles in the Centre do so entirely at their own risk and the States, their agents, officers or servants cannot accept liability for any loss or damage howsoever sustained. Lockers in the changing rooms are provided for short term use. The lockers may be cleared daily. Any property found in lockers will be treated as lost property. This does not apply to lockers rented under the 'Annual' scheme. Any clothing or effect found at the Centre will be kept in the lost property section for 10 days only and may then be disposed of. Items other than clothing are held at the Centre for a maximum of two weeks and then transferred to the Police station. |
User's Obligations A User Shall:- 1. Comply with all reasonable instruction and requests of the management. 2. Carry out and observe all instructions of the States relating to use of the Centre which may from time to time be published by notices on the premises or otherwise. 3. Retain tickets for production to a member of staff when requested. 4. By agreement pay to the States on demand, the amount of any damage (except damage from fair wear and tear) done or occasioned to the Centre or to the fixtures, fittings, apparatus, equipment, furniture or other contents thereof, by him/her or by any persons participated jointly with him/her in the use of the facilities or premises or by any persons in his care or his control. 5. Indemnify the States against all claims, demands actions or proceeding in respect of the death of or injury to any person, including the user, or damage to or loss of property belonging to any person arising out of the use of the Centre otherwise than as a result of the defective condition of the Centre or its' equipment or the negligence of the States their agents, officers or servants. 6. Indemnify the States against all claims, demands actions and proceedings in respect of any infringement of copyright or any unauthorised performances or use of recording apparatus or contrivance at the Centre by himself/herself or his/her agents. 7. Ensure that the part of the premises and any equipment used is left in a tidy and orderly condition by the end of the period of use. A User shall not,unless expressly authorised by the Management:- 1. Bring food, drink, drugs or any dangerous or obnoxious thing into the Centre. 2. Bring or permit to remain in the Centre any dogs or other animals except assistance dogs. 3. Sell or supply to other users of the Centre any goods or services of any description whatsoever. 4. Make an announcement or display any notice or sign at the Centre or perform any work which will infringe any copyright. 5. Alter or interfere with or misuse any equipment or fittings or part of the Centre. |
Breach of regulations In the event of any breach of these regulations by a user she/he may be required by the Management to leave the Centre and forfeit any charge paid by him/her or have his/her membership pass withdrawn without refund of the fee, but without prejudice to any claim or action which the States may have against him/her. |
Amendment of regulations The States reserve the right to amend or make additions to these regulations without notice. |
